Penalties for Indecent Contact with a Minor in Texas
As previously mentioned, the crime of indecent contact with a minor is incredibly serious. Under Texas Penal Code 21.11, Section (a)(1), a person can be convicted of indecency with a child if he or she has sexual contact with a minor or causes a minor to engage in sexual contact. This includes contact that occurs over clothing. In other words, indecency with a child by exposure does not have to occur for the state to convict someone of indecent contact with a minor. In addition, penetration is not required for a conviction for indecent contact with a child.
In Texas, indecent contact with a minor is charged as a felony of the second degree and is punishable by:
- A minimum of 2 and a maximum of up to 20 years in state prison
- A fine of up to $10,000
- Probation/deferred adjudication of 2 to 10 years, depending on criminal history
Extraneous factors, also known as aggravating factors, may lead to harsher penalties. Additionally, a person with a prior criminal history will also likely face more severe consequences if convicted of indecent contact with a minor.
